Terms & Conditions

These are the terms and conditions (Terms), upon which Findmypast Newspaper Archive Limited (we, us and our) will allow you to access our database of historical Newspapers through the website www.britishnewspaperarchive.com (Site). 

References in these Terms to “Newspapers” mean the historical newspapers and associated materials made available through the Site. 
Please read these Terms carefully before you start to use the Site. By using the Site, you indicate that you accept these terms of use and agree to be bound by them. We reserve the right to change these Terms from time to time by changing them on the Site, and by continuing to use the Site, you accept these changes and agree to be bound by them. It is your responsibility to check the Terms each time you use the Site. If we change the terms in a manner which may materially adversely affect your rights or obligations, we will notify you by email prior to the change taking effect.  

The British Newspaper Archive is owned and run by Findmypast Newspaper Archive Limited. It is a commercial partnership with the British Library. 

In turn, we are wholly owned by Findmypast Limited, the same company that brings you family history websites Findmypast and GenesReunited. 

Ultimately, we are owned by DC Thomson & Co Limited, a UK-based, family-owned business that has been involved in publishing since the mid 19th century. 

Findmypast Newspaper Archive Limited is a limited liability company registered in Scotland (Company number SC375068) having its registered office at Gateway House Luna Place, Dundee Technology Park, Dundee, DD2 1TP. Our VAT registration number is GB 927 1672 12. 

For customers outside the UK, the company responsible for your subscription under these Terms is listed in Clause 25A. 

The advertisement of Micropayments and Subscriptions on the Site and other digital platforms and/or in other publications is an invitation to treat only and any order from you constitutes an offer to us to buy such Subscriptions and make Micropayments. All orders are subject to acceptance by us. There will be no contract between you and us unless and until we accept your order in accordance with the procedures detailed in these Terms. 

From time to time, we may propose special offers or temporary promotions which may either be published on the Site and other digital platforms or in other formats such as marketing emails, newspapers, and magazines. These may be subject to additional terms and conditions that we will let you know about in those offers. 

In addition, the following additional terms may apply to your use of the Site and are deemed incorporated into these terms: 

• our Community Guidelines 
• our Privacy Policy 
• our Cookies Policy 

These Terms apply to all users of the Site, including those who redeem voucher codes purchased from us or a third party, except for commercial users. If you wish to make any commercial use of Micropayments or Subscriptions or to use our Newspapers in a work-related capacity (e.g. an organisation or company that carries out research using our Newspapers or a library), please contact us to find out more about corporate access to the service using the Contact Us link on the Site. Separate terms and conditions apply to corporate access and these will be provided to you before purchase. 

If you are a self-employed professional genealogist using the Site in your professional capacity (Genealogist), you may use the Site to carry out research for others using either Micropayments or a Subscription in accordance with and subject to these Terms. Genealogist users shall not, however, be deemed a consumer under these Terms and consumer rights (other than those which cannot be excluded under applicable law) will not apply to such users. Please refer to specific sections of these Terms that clarify exclusions applicable to Genealogists. 

You can see the different types of Newspapers held on the Site for free; however, to access and view most Newspapers or use certain features of the Site, you will need to register with the Site and purchase a Subscription or use Micropayments or a voucher. 

In addition, we make certain Newspapers available to view free of charge through our Free to View collection and through pages we make free to view on a rotating basis. Access to all other Newspapers requires a Subscription, Micropayments or a voucher. 

It is your responsibility to ensure your computer system meets any necessary technical and compatibility specifications to enable you to access and use the Site. It is also your responsibility to ensure that all persons who access the Site through your internet connection are aware of these terms and comply with them. 

We may, from time to time, restrict access to certain features, parts, or content of the Site or the entire Site to users who have registered with us. You must ensure that any registration details you provide are accurate and up to date. If you choose, or you are provided with, a login ID (such as a username and password or other identifier) as part of our security procedures, you must treat such information as confidential and must not reveal it to anyone else. You are responsible for all activities that occur under your login ID and must notify us immediately of any unauthorised use or other security breach of which you become aware. By using the Site as a registered member, you accept on your own behalf and on behalf of the organisation (if any) named on your registration form to be bound by these Terms of Use and references to 'you' and 'your' refer to you individually and to your organisation. We reserve the right to disable any login ID, at any time, if in our opinion you have failed to comply with any of the provisions of these terms and conditions or if any detail you provide for the purposes of registering as a user proves to be false. 

You may use Micropayments or a Subscription on the Site for your own personal use, for example to research a specific topic or your family history. You may also assist friends and family with their  historical research by telling people about the Newspapers available on the Site and how and where they can be found. However, please note our terms below in relation to the use of your login details. 

Aside from our advertisers who may display their advertisements in accordance with our terms and conditions of advertising on our Site, you may only use the Site for non-commercial and private professional use (as a self-employed, sole trading Genealogist) and only in accordance with these terms and conditions. You may retrieve and display content from the Site on a computer screen, print and copy individual pages and, subject to our terms, store such pages in electronic form. Additional terms may also apply to certain features, parts, or content of the Site and, where they apply, will be displayed before you access the relevant features, parts, or content. 

Except to the extent expressly set out in these terms and conditions, you are not allowed to 

• store pages of the Site on a server or other storage device connected to a network or create an electronic database by (i) systematically downloading and storing all or any of the pages of the Site or (ii) by screen scraping, framing, caching, data extraction or programmatic access whether by robot, spider, or otherwise or (iii) by printing pages of the Site in a systematic or regular manner so as to create a database in hard copy form; 
• collect or harvest personally identifiable information from the Site; 
• remove or change any legal notices or other content of the Site or attempt to circumvent security or interfere with the proper working of the Site or the servers on which it is hosted; 
• use the Site to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam); 
• use the Site to knowingly transmit any data, send, or upload any material that contains viruses, trojan horses, worms, time-bombs, keystroke loggers, spyware, adware, or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware; 
• attempt to gain unauthorised access to the Site, the server on which the Site is stored, or any server, computer, or database connected to our site or circumvent, disable, or otherwise interfere with our security-related features; 
• reproduce, copy, distribute, publicly display, or re-sell any part of the Site in contravention of these terms and conditions; 
• create links to the Site from any other website, without our prior written consent; 
• modify, translate, reverse engineer, decompile, or disassemble the Site or parts of the Site or create derivative works from the Site; 
• use the Site for any business, commercial, or public purpose, except when you have purchased a corporate subscription. 

We reserve the right to withdraw any linking permission granted without notice. If you wish to make any use of material on our site other than that set out above, please address your request to support@The British Newspaper Archive.co.uk 

You must only use the Site and anything available from the Site for lawful purposes (complying with all applicable laws and regulations), in a responsible manner, and not in a way that might damage our name or reputation or that of any of our group companies and affiliates. 

All rights granted to you under these terms and conditions will terminate immediately in the event that you are in breach of any of them and you must, at our option, return or destroy any copies of the materials you have made in breach of these terms.   

Further details about the types of Subscription available can be found on the Site here. Descriptions may be abbreviated but, to the best of our ability, are correct at the time of input onto the Site. Usage limits apply to Subscriptions. Please see below for further detail. The minimum initial Subscription term will be described during the order process. Some promotional offers and/or some Subscriptions may have a 12-month minimum term (subject to any right to cancel you may have - see further below). Some offers may not be available to existing subscribers. 

The renewal date of the Subscription you are purchasing is clearly stated before you finalise the purchase of the Subscription. 

When you purchase a Subscription, it is on a continuous basis, meaning your Subscription will automatically renew, for the same subscription period as the initial subscription period. Monthly Subscriptions are renewed each calendar month and 12-month Subscriptions auto-renew after the previous 12-month period has expired. For subscription terms 6 months or longer, we will send you a reminder notification to the email address that you provided to us, informing you of your upcoming renewal and any changes in price. The debit or credit card originally used for payment, will be charged based on your chosen Subscription package, on the day the Subscription automatically renews. 

You may elect not to renew a Subscription and can turn off the automatic renewal at any time (so long as this is no later than two working days before the current Subscription is due to expire), by i) going to ‘My Account’ and ‘My subscription’ page on the Site, selecting “Cancel subscription” or ii) contacting our customer support. If you do not turn off automatic renewal or cancel your Subscription in accordance with this process, we will automatically renew your Subscription and will take payment in accordance with this section 4. Turning off automatic renewal will mean your subscription expires on what would otherwise have been the next renewal date. Once expired, you will lose access to Newspapers, including any previously viewed Newspapers, with the exception of free-to-view Newspapers available on Site. More details can be found here 

Subject to any statutory right to cancel or receive a refund that you may have, we cannot provide refunds for an automatically renewable Subscription that has not been cancelled in accordance with this section. 

If you have a 1-month British Newspaper Archive  subscription that automatically renews each month, you can pause it by selecting to delay your renewal payment for one month effective from the end of your current monthly billing cycle (Pause Period). You can only pause your subscription payment once per billing cycle. During the Pause Period, you will still be able to view any Newspapers  that you accessed previously. Whilst your subscription is paused, you will not be able to view any records that you have not previously accessed. At the end of the Pause Period, your subscription will automatically reactivate, you will be billed in accordance with your current subscription price immediately and your subscription will continue on a monthly auto-renewal basis. You can choose to manually unpause your subscription at any time during the Pause Period. When you unpause, your card will be charged for a new billing term immediately. If you cancel your subscription during a Pause Period, you will not be charged for future billing cycles. Pay-per-view purchases are not available during a Pause Period. 

If eligible, you can upgrade or downgrade your Subscription at any time using the ‘Change subscription’ option in ‘My Subscription.’ Alternatively, you can contact customer support. Subscription upgrades are charged on a pro-rated basis. Some upgrades are subject to a minimum price, regardless of the pro-rated value. Upgrades take effect immediately. Downgrades take effect on the renewal date of your current Subscription l. If you have subscribed to one of our 12-month Subscriptions, you may be entitled to a loyalty discount of 10% off our listed Subscription price if you renew for a further 12-month Subscription (Discount). The Discount will not apply if you renew on a monthly Subscription basis. If you allow your 12-month Subscription to lapse but then renew it within 30 days of lapse, you will still receive the Discount. The Discount will be applied every time you renew one of our 12-month Subscriptions in accordance with the above. 

Gift Subscriptions

A The British Newspaper Archive Gift Subscription is a membership purchased by someone (the “Giftor”) for someone else (the “Giftee”) to use. Unlike standard The British Newspaper Archive subscriptions, Gift Subscriptions do not automatically renew. The Giftee can access The British Newspaper Archive Newspapers and features using their Gift Subscription from the “Gift Start Date” (defined below) until the purchased membership expires (the “Gift Term”). The Giftee can pay to upgrade their membership to a higher level during their Gift Subscription. Purchases and use of Gift Subscriptions are subject to these Special Terms, in addition to general The British Newspaper Archive Terms and Conditions.  

Purchasing a Gift Subscription

You can purchase a Gift Subscription if you already have a The British Newspaper Archive account or by using our guest checkout option. Upon purchase, the Giftor chooses the date on which the Gift Subscription will be sent to the Giftee, which must be within 90 days of the purchase date. The British Newspaper Archive will email a unique Gift Subscription redemption code to the Giftee on the date the Giftor chose. It is at the discretion of the Giftor if they wish to inform the Giftee about their Gift Subscription before the Giftor’s chosen email send date. The British Newspaper Archive will also send a purchase confirmation email to the Giftor. The Giftee will have 365 days to redeem the Gift Subscription from the date they receive their Gift Subscription access code. The “Gift Start Date” is the date on which the Giftee redeems their unique access code and starts their Gift Subscription.  

The British Newspaper Archive assumes no responsibility or liability for undelivered Gift Subscriptions due to invalid email addresses, spam filters or other reasons outside of The British Newspaper Archive’s control. 

The British Newspaper Archive will first contact the Giftee about their Gift Subscription on the Giftor’s chosen send date. 

Redeeming a Gift Subscription

The Gift Subscription will begin when the redemption code is redeemed and expire at the end of the Gift Term. If the Giftee wishes to continue to access The British Newspaper Archive beyond the Gift Term, they can enter their billing details at any point to have their Gift Subscription automatically renew into a paid subscription. Upon first access, the Giftee will be required to create a The British Newspaper Archive account and agree to The British Newspaper Archive Terms and Conditions and Privacy Policy. 

General

The British Newspaper Archive assumes no responsibility for the loss or misuse of Gift Subscription redemption codes. The British Newspaper Archive Gift Subscriptions have no cash value or other value and can only be used to access The British Newspaper Archive during the Gift Term.  

The British Newspaper Archive members with an active subscription cannot redeem a gift membership. The British Newspaper Archive Gift Subscriptions cannot be extended or upgraded currently.

Micropayments may be used instead of a Subscription or to access Newspapers not included in your Subscription. Micropayments may be used to view any Newspapers on the Site unless they are subject to a special collection, and this will be made clear on the Site. Using Micropayments you will be able to pay for individual Newspapers with the monetary cost clearly displayed. You will need to pay for each new Newspaper viewed unless you have already purchased that Newspaper. Some Newspapers may cost more to view than others, and we may change the cost charged to view a Newspaper from time to time. The cost to view a Newspaper will be clearly shown prior to a payment being made.  

To the extent permitted by applicable law, Micropayments are non-refundable, so you should be sure you are purchasing the right Record before you make a payment. 

To purchase a Subscription or use Micropayments, you must first register with the Site. In registering, you will be providing certain personal information to us that shall be processed in accordance with our Privacy Policy. You must keep your registration and login details private and secure at all times and not share them with any other person. If you are aware that someone has access to your registration or login details, please update your password in the 'My Account' page of the Site as soon as possible. You must keep your personal information, including your email address, accurate and up to date. 

A contract between us begins when we send you the Confirmation Email after accepting your payment for Micropayments or a Subscription. After entering into the contract, we will be under a legal duty to supply you with the Micropayments and/or Subscription that are in conformity with these Terms and our contract with you for the same. 

Vouchers (Vouchers) may be purchased from authorised third party stockists. We will not accept Vouchers unless they have been purchased from an authorised stockist. 

Vouchers can then be redeemed on the Site for a Subscription, so long as the value of the Voucher covers the value of the Subscription requested.  

Voucher codes are unique and cannot be used more than once. Vouchers cannot be exchanged for cash, gift vouchers, or any other cash alternative and we may restrict the use of Vouchers on certain products or apply minimum spend restrictions. Any restrictions will be made clear on the Site. 

If you are unable to provide us with a valid Voucher code or if the Voucher code you provided has already been activated you will not be able to redeem that Voucher for a Subscription. We reserve the right to cancel Voucher codes at any time before they have been used if we believe you are using a Voucher code unlawfully. 

If you have any queries about a Voucher and it was purchased from us, please contact Customer Support at [email protected]. If your voucher was purchased from an authorised stockist, please contact the stockist from whom you purchased the voucher. 

Vouchers cannot be redeemed against Micropayments. 

We may offer discounts and promotions; sometimes via a discount code (Discount Code) from time to time. If not automatically applied, these can be redeemed by entering the Discount Code into the box on the 'Select a Subscription' or 'Micropayments' page on the Site prior to purchasing a Subscription or making a Micropayment. 

If you have purchased a Subscription using a Promotion or a Discount Code then, after the initial Subscription period, your Subscription will be automatically renewed at the standard list price on the Site unless you un-tick the 'auto-renew my Subscription' tick box in the 'My Account' section of the Site. 

Some Promotions or Discount Codes are restricted to one use per individual (where an individual is identified by their own individual email address and/or their own computer/device). Some Promotions or Discount Codes may be multi-use. This will be made clear on the applicable Promotion or Discount Code. If you are unable to provide us with a valid Discount Code, or if the Discount Code has expired, your discount will not be awarded. 

From time to time we may promote discount codes/offers which are applicable to first time subscribers only. This will be made clear at the point of promoting the offer. We will not honour or be otherwise responsible for discount codes which are sourced from third party websites/forums. 

Promotions or Discount Codes cannot be exchanged for cash, gift vouchers, or any other cash alternative and if we believe you are using a Promotion or Discount Code improperly we may refuse to honour it.

We may, from time to time, offer a period of free access to Newspapers on the Site (Free Access). Where you hold a current subscription or unused credits we will send you an email to let you know when a Free Access period is about to start (Free Access Email). 

We may limit Free Access to a weekend (Free Weekend), or such other time period we decide. To access Newspapers during a Free Access period or a Free Weekend, you will need to be registered and signed in to the Site. 

At our discretion, some Newspapers may not be available during Free Access or a Free Weekend (Excluded Newspapers). The Free Access and Free Weekend Emails will provide full detail of how your particular Subscription or Micropayments are affected during the Free Access or Free Weekend. 

Access to Excluded Newspapers will continue to require the use of a Subscription or Micropayments. 

We may remove certain product features during a Free Access period or a Free Weekend such as the ability to download Record images. Usage limits may also apply on the number of Newspapers you may access during a Free Access period or a Free Weekend - find out more about fair usage. 

You will be informed whether your Subscription qualifies for a free gift. Any free gifts offered when you purchase a Subscription are subject to availability. If a free gift is included in a Subscription you purchased, we will use our reasonable endeavours to deliver the free gift within 20 working days of the conclusion of the contract. If you cancel your Subscription and you have received or redeemed a free gift with this Subscription, you must return the free gift to us unopened and in a saleable condition, to the address we notify to you. You are legally obligated to take reasonable care of the free gift whilst it is in your possession. If you fail to comply with the obligations to return the free gift to us and/or take reasonable care of it, we may deduct the cost of any loss, or deterioration, of the free gift from you, up to the retail price of the free gift, from the refund to which you are otherwise entitled. You will be responsible for the cost and risk of returning the free gift to us. 

If we deem any free gift offer to be misused, we reserve the right to withdraw the offer and not fulfil the gift promotion. We reserve the right to withdraw a free gift promotion at any time. 

We have a fair usage limit on the number of Newspapers you may view. Different limits apply depending on whether you are accessing Newspapers for free or on a Subscription, Micropayment, or Trial basis. 

• If you access Newspapers on a Subscription basis, you may access a maximum of 6,000 Newspapers in any calendar month (Month), subject to a maximum of 500 Newspapers in any 24 hour period (Limit). The Limit does not apply where you are accessing Newspapers on a Micropayment basis as such access is 'pay as you go'. 
• During a Free Access period or Free Weekend, you may access a maximum of 200 Newspapers per 24hr period (Free Access Limit). 

If you are viewing Newspapers on a Subscription basis, once the Limit has been reached, you will need to wait for the next Month to start, when the Limit is automatically reset. If you are on a Trial or a Free Access period or Free Weekend, you will need to buy a Subscription or use Micropayments to view more Newspapers. 

There is no carry over permitted of any unused Limit or Free Access Limit from one Month to the next Month.

When you purchase a Subscription or make a Micropayment, you will need to provide us with certain personal data to enable us to process your order. 

Our privacy policy sets out how we collect, hold, use and disclose any of your personal information you give us. 

Any personal data which you provide to us when you register with the Site or purchase a Subscription or make a Micropayment must be true, accurate, current, and complete in all respects. You agree not to impersonate any other person or entity or to use a false name or a name that you are not authorised to use when purchasing Subscriptions. You will notify us immediately of any changes to any personal information supplied to us. 

By using the site or engaging with us online, you indicate that you accept and agree to be bound by our Community Guidelines. The guidelines cover, but are not limited to, The British Newspaper Archive's websites, blog, and presence on Facebook, YouTube, and Twitter globally. You warrant that your contribution does comply with those standards, and you indemnify us for any breach of that warranty. 

If you use the Site to publish material  make comments, or participate in a forum or our communities, you do so in accordance with our terms of use and community guidelines. You are solely responsible for managing the content that you create, including managing the privacy settings that are available to you. You indemnify us for any failure to obtain the appropriate permissions of the owner of rights in the content you upload and for any breach of these terms of use. We are not liable or responsible for the third-party content on this Site including links to other sites and resources. 

We encourage you to take part, to engage with people, to share your discoveries, and to help your fellow community members. Transgressors may be temporarily or permanently banned from The British Newspaper Archive's channels and may have their subscriptions cancelled and their access to The British Newspaper Archive's Newspapers removed. Complaints about the content of any posting must be sent to [email protected] and must contain details of the specific posting giving rise to the complaint. Further details of our take down procedure are set out in our Community Guidelines. 

By publishing any content, you consent to us making it available to other users of the Site and to users of other websites that are either part of our company group or with whom we have a partnership, as well as by internet search engines. You also consent to us using it for marketing, product improvement, or any other commercial purposes. 

Your registration, payment information, and private conversations between members are always kept private and secure. 

Subject to the liability section below, we exclude all liability for any loss you may suffer as a result of content created by you and made available by you in accordance with this section being abused by a third person. 

We do not control the material submitted by other users (collectively 'Postings'). We do not screen, moderate, or monitor any content either before or after it is posted or sent; although, we may use filtering tools from time to time to screen or suppress certain information or language. You acknowledge that all Postings express the views of their respective authors and not our views. Your content may be viewed by any user of the Site unless it is posted in a restricted members-only area, in which case, only we and our members may view that content. We reserve the right, in our sole discretion, to delete any Posting submitted by you and/or to close any topic, at any time without notice to you. 

You should never upload material that would violate the intellectual property or other rights of other people or organisations. Before posting or sending any content referring to or relating to any living person, you must obtain their explicit consent to be referred to on the Site and you warrant to us that you have done so prior to posting such material. If the living person is under 16, you must obtain the consent of their parent or guardian to this use. 

By submitting your content or Postings, you give us and our group companies and our affiliated companies and third-party service providers permission and grant a licence to same to use, copy, adapt, edit, translate, make available, and transmit or otherwise communicate, display, and publish such content (or any part of it) and to create any derivative works from it together with the ability to sub-licence the same whether we refer to your user name or not, and to the extent permitted by law, you waive any moral rights you may have in your content (i.e. the right to be identified as author of or to object to derogatory treatment of such content). You unconditionally and irrevocably consent to us and our licensees using your content in any way which would otherwise infringe your moral rights. The grant of these rights to us is perpetual, sub-licensable, irrevocable, worldwide, and royalty-free. We can use all or part of your content in advertising and marketing materials for our products. It is in our sole discretion whether or not we use your content. We can remove your content even if you have complied with our Community Guidelines. If you do not agree to this, please do not submit any content to us.  

This pertains specifically to photos which were given to The British Newspaper Archive through social medial channels. The photos are published as part of the The British Newspaper Archive photo collection. 

• In order to submit a photo you must be over 18 years of age. 
• You confirm that the answers you have provided on the submission form are true and not misleading. 
• You give us and our group companies and our affiliated companies and third-party service providers permission and the right to use, copy, adapt, edit, translate, make available, and transmit or otherwise communicate, display, and publish such content (or any part of it) and to create any derivative works from it together with the ability to sub-license the same in such manner as we see fit to promote our (or our affiliates or group companies’) services. 
• To the extent permitted by law, you waive any moral rights you may have in your content (i.e. the right to be identified as the author of or to object to derogatory treatment of such content). You unconditionally and irrevocably consent to us and our licensees using your content in any way which would otherwise infringe your moral rights. The grant of these rights to us is irrevocable, worldwide, and royalty-free. We can use all or part of your content in advertising and marketing materials for our products. 
• You confirm that you have, to the best of your information and belief, the right to grant the rights in the foregoing paragraph and that to the best of your knowledge, our use of the content will not infringe the intellectual property rights or other personal rights (including rights of privacy and moral rights) of any other person. 
• You acknowledge that we retain sole discretion as to whether or not we use your content and that we may withdraw it from publication at any time at our sole discretion. 

Although you may be able to register as a user of our Site if you are under 18, please note that we do not sell Subscriptions or allow the use of Micropayments to those under the age of 18. The purchase of Subscriptions and the use of Micropayments must be made by an adult of 18 years or older, using their own account details. 

By submitting an order, you are confirming to us that you are 18 or over. 

If we discover or are of the opinion that you are not legally entitled to order a Subscription or use Micropayments, we shall be entitled to cancel the order immediately, without notice to you. 

All prices are inclusive of VAT or similar taxes where applicable at the current rates. 

All prices are correct at the time they are given. Prices are liable to change at any time, but changes will not affect orders for which you have already paid. If we change the Subscription price (which we may do at any time), this will not affect your current Subscription, but the higher price will apply on your Subscription renewal. We will always inform you by way of email if any Subscription charges will be increased in your next renewal period, and you can always choose not to renew your Subscription (see Continuous Subscriptions above). 

Subscription upgrades are charged on a pro-rated basis. Some upgrades are subject to a minimum price, regardless of the pro-rated value. Your price will always be displayed at the point of purchase before you confirm your upgrade. 

It is always possible that some of the Micropayments or Subscriptions listed may be incorrectly priced. We will verify prices as part of our sale procedures so that the correct price will be stated at the point of sale. If we discover a manifest error with our prices then we may cancel your order and refund you. 

When making a purchase via the Site, you can pay using a credit or debit card through our secure third-party payment gateway. All credit/debit card purchases are subject to validation checks (which you consent to) and authorisation by the card issuer. If the issuer of your payment card refuses to or does not for any reason authorise payment to us for a particular purchase, we will not accept your order. Please note that it is possible that your card issuer may charge you an online handling or processing fee. We are not responsible for this. 

The payment card originally used for purchasing a subscription will be charged based on the chosen Subscription package, on the day the Subscription automatically renews. However, any subsequent payment cards used to for purchase will automatically update the default card used for all future payments (Subscriptions or Micropayments). Simply, the most recent, valid (unexpired) payment card used for any purchase will become the default for all future payments. 

Pre-authorisation 

When you enter your details for payment or update of payment card, we will hold a pre-authorisation amount of £0.01/$0.01/€0.01 to validate your card. This is held from your account temporarily (1 – 5 working days) but is not charged. 

For customers that reside in Australia, the consideration for any supply under or in connection with these terms and conditions are inclusive of GST.

This Section shall only apply to consumer users of the Site. If you are a Genealogist or other commercial user of the Site, you will not have the right to cancel a Subscription in accordance with the below. 

If you change your mind or for any other reason decide you do not want a Subscription package, you may cancel your order within fourteen days after the day on which the contract is entered into (Cooling-Off Period). Where you have given your express consent to start access to Newspapers in accordance with the section below, then we will not be obliged to provide you with a refund (see Refunds below), however we may give you a refund in this circumstance if no Newspapers have been viewed. 

To cancel the purchase of a Subscription you must inform us 

• in writing either to the address noted at the end of these Terms or by emailing us at [email protected] giving us your name, address, and order reference; or 
• by telephone by calling us on +44 (0)20 3326 6300 Monday - Friday 5am - 1.30pm (EST) +1 (855) 246-8234 Monday - Friday 7am and 5pm (ET), giving us your name, address, and order reference. 

The right to cancel will apply to a Subscription taken out after a Trial has ended and where you did not cancel your Trial prior to the expiry of the Trial. 

After cancellation, you will lose access to any previously viewed Newspapers with the exception of free-to-view Newspapers available on Site. More details can be found here. 

Please note that where you have obtained a Subscription via redeeming a Voucher on the Site, these cannot be cancelled in line with the above since these rights only apply to distance sales. You may have an alternative right to cancel or exchange if this is offered by the stockist who originally sold you the Voucher. You will need to contact the stockist who you purchased the Voucher from. 

Details of the consumer rights described above, and an explanation of how to exercise them, are provided in the Confirmation Email. Nothing in this section affects your legal rights.

This Section shall only apply to consumer users of the Site. If you are a Genealogist or other commercial user of the Site this Section does not apply. 

If you wish to access Newspapers before the expiry of the Cooling-Off Period, then you expressly request that we begin the supply of digital content (i.e. allow you to access Newspapers) before the end of the Cooling-Off Period. You acknowledge that once we have begun the supply of the Newspapers that you lose the right to cancel and we shall not be obligated to provide a refund. 

This Section shall only apply to consumer users of the Site. If you are a Genealogist or other commercial user of the Site this Section does not apply. 

Subject to the following sentence, if you cancel a contract for Subscriptions within the Cooling-Off Period then we will refund all monies that you have paid to us in respect of the contract being cancelled. However, as stated above, if you have given your express consent to us to provide access to Newspapers in the Cooling-Off Period and if we have begun that supply, we shall not be obligated to provide a refund. 

No refunds will be issued where Micropayments have been used as the payment method. 

We will aim to process any refund due to you within 3 working days and, in any case, not later than 14 days after the day on which we were informed about your decision to cancel the contract. Refunds can only be made to the original source of payment / payment method. 

We are the owner or licensee of all intellectual property rights in any content of the Site (including text, graphics, software, photographs, and other images, videos, sound, trademarks, and logos). 

Except as expressly set out here, nothing in these terms and conditions gives you any rights in respect of any intellectual property owned by us or our licensors and you acknowledge that you do not acquire any ownership rights in the Site or its content. 

The Newspapers on the Site are provided by third-party licensors (Licensors). In most instances the copyright or database rights owner is displayed as part of the Newspapers. The Licensors shall retain all intellectual property rights in the Newspapers. You cannot use the Newspapers to create your own work such as databases, articles, blogs, or books, or copy or reproduce the Newspapers (either in whole or in part), or publish them, for a purpose other than personal use, without our prior written permission (and/ or that of the Licensor of the Newspapers). 

If you infringe the rights of a Licensor whose content is made available on the Site, that Licensor may also take action against you directly. 

Our status (and that of any identified contributors) as the authors of material on our site must always be acknowledged. If you wish to publish or otherwise professionally use the Newspapers please contact us. 

If you use any content from the Site, whether online or offline, you must acknowledge the source by referencing the British Newspaper Archive (www.britishnewspaperarchive.com), The British Library Board, and the copyright statement shown on the relevant page. Copyright information for each newspaper is available via the 'newspaper information' icon in the image viewer. 

You must not modify the paper or digital copies of any material you have printed or downloaded in any way, and you must not use any illustrations, photographs, video, or audio sequences or any graphics separately from any accompanying text. In the event you print off, copy, or store pages from the Site (only as permitted by these terms and conditions), you must ensure that any copyright, trademark, or other intellectual property right notices contained in the original content are reproduced. 

If you believe that you own the copyright or any other intellectual property right in any of the Newspapers on the Site and we have not recognized you as the copyright owner, please contact us and we will work with you to resolve this. 

We may change the format and content of the Site from time to time. You agree that your use of the Site is on an 'as is' and 'as available' basis and at your sole risk. 

Whilst we try to make sure that all information contained on the Site (other than any user-generated content) is correct, it is not intended to amount to authority or advice on which reliance should be placed. You should check with us or the relevant information source before acting on any such information. 

Except to the extent expressly set out in the additional terms and conditions mentioned at the top of these terms of use and to the extent permitted by applicable law, we make or give no representation or warranty as to the accuracy, completeness, currency, correctness, reliability, integrity, quality, fitness for purpose, or originality of any content of the Site and, to the fullest extent permitted by law, all implied warranties, conditions, or other terms of any kind are hereby excluded. To the fullest extent permitted by law, we accept no liability for any loss or damage of any kind incurred as a result of you or anyone else using the Site or relying on any of its content. No liability can be accepted by us in respect of any changes made to the content of the Site by unauthorised third parties. We cannot and do not guarantee that any content of the Site will be free from viruses and/or other code that may have contaminating or destructive elements and cannot accept any liability for the same. It is your responsibility to implement appropriate IT security safeguards (including anti-virus and other security checks) to satisfy your particular requirements as to the safety and reliability of content.

We reserve the right to make changes to the Newspapers and services we offer on the Site without notice at any time. This includes the right to withdraw any Newspaper offered on the Site. We may, for example, cease to provide Newspapers from a particular data set at any time. We shall not be liable to anyone for withdrawing any Newspapers from the Site or for refusing to accept an order. 

Where possible, we add Newspapers to your Subscription at no extra cost; however, if we launch a major new collection of Newspapers, for example, we may need to make a separate charge for access to such Newspapers. This will be made clear on the Site. 

If you are in breach of any of these Terms, we will notify you in writing of the breach and give you [14] days to remedy the breach (Cure Period), and failing that, suspend or terminate your Subscription and/or access to Micropayments. We shall not be liable to you to refund any Subscription or Micropayment fees already paid, unless you can prove to us that you were not using the Newspapers in contravention of these Terms. 

If we cannot take payment for a renewed Subscription or if you regularly exceed the limits on use of Newspapers set out in these Terms, then we may terminate your access to Newspapers (provided that if you regularly exceed the limits on use of Newspapers, we will first notify you in writing of the issue and give you [14] days to remedy the issue). In such a circumstance, you will not be entitled to a refund on any amounts paid, unless you can prove to us that you were not using the Newspapers in contravention of these Terms. 

We may accept or reject any application to register with us at any time and we may suspend or terminate your account if we believe you have breached the terms of use or at our discretion. 

Nothing in these Terms shall limit or exclude our liability to you for death or personal injury caused by our negligence or for fraudulent misrepresentation or any other liability that may not, under applicable law, be limited or excluded. 

Subject to this, in no event shall we be liable to you (whether caused by tort or by breach of contract or otherwise) for loss of anticipated savings, data, wasted time, indirect or consequential losses, or for any loss of profit, revenue, contracts, goodwill, or other similar losses whether directly or indirectly incurred and any liability we do have for losses you suffer arising from any contract shall not exceed the purchase price of the relevant Subscriptions and/or Micropayments and is strictly limited to losses that were reasonably foreseeable. Losses are foreseeable where they could be contemplated by you and us at the time your order is accepted by us. 

We cannot guarantee the uninterrupted or error-free operability of the Site. Access to the Site is permitted on a temporary basis and we reserve the right to withdraw, modify, or suspend the service we provide on the Site without notice. To the extent permitted by applicable law, we will not be liable to you or any third party for any unavailability, modification, suspension, or withdrawal of the Site, or any features, parts, or content of the Site at any time for any period. 

We shall not be obliged to perform our obligations under these Terms to the extent that we are prevented, hindered, or delayed in the event of 'Force Majeure' meaning an event beyond the control of the Authority and the Operator, which prevents a Party from complying with any of its obligations under this Contract, including but not limited to: act of God such as fires, explosions, earthquakes, drought, tidal waves and floods; war; hostilities; invasion; act of foreign enemies; rebellion; revolution; insurrection; military or usurped power; civil war; contamination by radioactivity from any nuclear fuel; riots; commotion; strikes; failure of transport links; failure of telecoms links; unavailability of the internet or any utility; go slows; lock outs or disorder, unless solely restricted to employees of the Site or of subcontractors; and acts or threats of terrorism. 

To the extent permitted by law, we exclude any liability arising out of any dealings you have with third parties that take place using or facilitated by our website unless specifically agreed elsewhere in our terms of use. 

You are responsible for and agree to pay us any losses, costs or expenses that we suffer as a result of you failing to comply with these terms of use. 

Any software is downloaded at your own risk. 

The Site may, from time to time, include links to external sites and banner advertising. We have included links to these sites to provide you with access to information and services that you may find useful or interesting, but we accept no responsibility for their content nor for their compliance with any laws and regulations. We have no control over the content of these sites or for anything provided by them and do not guarantee that they will be continuously available. We accept no responsibility for these sites or any loss or damage that may arise from your use of them. The fact that we include links to such external sites does not imply any endorsement of or association with their operators.

If any part or provision of these Terms is found to be unenforceable, this shall not affect the validity of any other part or provision. 

You may not assign, sub-license, or otherwise transfer any of your rights under these Terms. We may assign these Terms or any rights hereunder without your consent or notice. 

These Terms supersede any previous versions. 

These Terms shall be governed by English law, and you agree that any dispute between us regarding them or the Site will only be dealt with by the English courts, provided that, if you are a consumer and not a business user and live in a part of the United Kingdom other than England, the applicable law of that part of the United Kingdom will govern and any dispute will only be dealt with by the courts there. Nothing shall prevent us from bringing proceedings to protect our intellectual property rights before any competent court. 

Nothing in these Terms restricts or limits any rights you may have under the consumer‑protection laws of your country or province of residence (including, without limitation, the US Federal and State laws, the EU Consumer Rights Directive, and the Australian Consumer Law). 

For customers whose billing address lies outside the United Kingdom, Findmypast Newspaper Archive Limited acts as agent on behalf of the local contracting entity responsible for providing the Service as follows: 

• United States: Mocavo Inc.   

• Ireland: Findmypast Ireland Limited   

• Australia: Findmypast Australasia Pty Ltd   

For customers in all other territories (including Canada and New Zealand) the contracting party is Findmypast Newspaper Archive Limited.   

The entity listed above for your country is the contracting party to your subscription and is responsible for supplying the Service under these Terms. 

Nothing in this Agreement is intended to have the effect of excluding, restricting or modifying the application of all or any of the provisions of Part 5-4 of the Australian Consumer Law, or the exercise of a right conferred by such a provision, or any of our liability in relation to a failure to comply with a guarantee that applies under Division 1 of Part 3-2 of the Australian Consumer Law to a supply of goods or services. 

For customers that reside in Australia, our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled: 

• to cancel your service contract with us; and 
• to a refund for the unused portion, or to compensation for its reduced value. 

You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract. This  limitation applies only to the extent permitted by section 64A of the Australian Consumer Law.

The British Newspaper Archive Limited acts as agent for the relevant contracting entity (see Clause 25A). The contracting entity listed in Clause 25A is responsible for statutory consumer rights and remedies in your country. 

From time to time, we may make new products, features, or services (“Beta Features”) available as part of a beta program or new product testing. By accessing or using any Beta Features, you acknowledge and agree that they are provided “as is” for testing and feedback purposes only, may be incomplete or contain bugs, and may be modified, suspended, or removed at any time without notice. Use of Beta Features is at your own risk, and we make no guarantees regarding their reliability, availability, or performance. We are not liable for any issues arising from your use of Beta Features, including errors, data loss, or service disruptions. Any feedback you provide may be used by us without restriction or compensation. Use of Beta Features is subject to our Privacy Policy and applicable laws, and all intellectual property rights remain with us or our licensors.
